    Spotting Red Flags and Avoiding Pitfalls

    This session covers the three ways that firms are currently handling e-discovery through a cost benefit analysis standpoint and what has the potential for sanctions.  The analysis is conducted with the use of a sample data set that could be found in any litigation matter today.  It covers many of the terms and ideologies that are commonly seen in the ESI space.  This MCLE has been utilized by firms for the following: 

    (1) Introduction to efficient e-discovery review and production

    (2) How to justify a Protective Order for production of electronic files due to burden of cost

    (3) What red flags to look for when trying to get a Motion to Compel for production of electronic documents.

    This webinar qualifies for 1 hour of CLE credit.

     Ross Mecham, Esq.

         

    Ross Mecham is an eDiscovery Consultant with DTI, a global Litigation Process Outsourcing provider, serving the Southwestern United States.  He helps law firms and corporate legal departments understand and manage their eDiscovery needs, using technology and efficient workflows to reduce risks and costs while increasing deliverable quality.

    An attorney with over a decade of experience across all phases of electronic and paper discovery, his career spans state, federal, and international matters, as well as the development of internal corporate discovery practices.  Working in numerous industries for corporate, individual, and public sector clients, prior cases include intellectual property, employment, and business tort actions, data breach and internal investigations, and regulatory requests.

    At the University of California, San Diego, Ross captained the men’s water polo team, graduating with a B.A. in Philosophy.  After earning his J.D. at Santa Clara University, the Silicon Valley native continues to pursue his interest in the technologies shaping modern life and the legal profession.

    Whether you are on the team that is pursuing a product liability personal injury claim or on the team that is defending against the claim, the criteria for prevailing is much the same. You will learn what the overall criteria are for a valid product liability claim. We will further examine red flags that can affect your side’s ability to prevail and suggestions on how to manage them.

    Criteria and Red Flags discussed include:

    • Identifying the party or parties actually responsible for the injury
    • How and why did the injury occur?
    • What really happened despite the story presented by the injured claimant?
    • Determining the likelihood of substantiating negligence
    • Strict Liability criteria for prevailing
    • Identifying a design or manufacturing defect
    • Evidence collecting and protecting
    • Expert witnesses – need for, types and roles
    • Interrogatories – Use and abuse
    • Costs of either pursuing or defending against a claim:
      • Plaintiff investments
      • Contingency fee considerations
      • Defense client costs
      • Better-advised to settle or dispute

    Dr. Arthur Eckstat has served as an Engineering Consultant & Expert Witness for over 15 years, specializing in Products Liability Personal Injury matters including wrongful death. Art is often approached by plaintiff attorneys to support what would be an unwinnable claim. He created Lawsuit Consultant (www.lawsuitsconsultant.com) to help Products Liability Plaintiff Attorneys learn how to choose, craft and conduct winning cases while identifying and avoiding losing or under-performing cases. That service expanded to helping Defense Attorneys and insurance companies learn how to determine the validity of injury claims. Regardless of which side of an injury claim you’re representing, two primary questions are, “How was the claimant injured?” and “Why was the claimant injured?”

    Art possesses a Mechanical Engineering degree and an earned Doctorate. He took early retirement from the corporate worlds of Automotive and Aerospace engineering where he received international recognition and accolades from both internal and external customers for his unique ability to see and explain what others have missed. He has successfully bridged the breach between Academic and Practitioner. Art was honored as a Contributor to Aviation History by Donald Engen, Director of the Smithsonian National Air and Space Museum in a ceremony held at the museum in Washington, DC.
